DMCA Copyright Policy

Notice-and-takedown procedure for copyright claims on Hearth.

1. Overview

Hearthmade ("Hearth") respects intellectual property rights and expects users of the Hearth platform to do the same.

This policy describes how to submit copyright infringement notices under the Digital Millennium Copyright Act (17 U.S.C. Section 512) and how Hearth responds.

Hearth's designated DMCA agent is registered with the U.S. Copyright Office. Agent contact information appears in Section 5 below.

2. Filing a DMCA takedown notice

If you believe content on the Platform infringes your copyright, send a written notice to our DMCA agent with all of the following:

  • Your physical or electronic signature.
  • Identification of the copyrighted work you claim has been infringed.
  • Identification of the infringing material on Hearth (URL or sufficient detail to locate it).
  • Your contact information (address, telephone, email).
  • A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Incomplete notices may not be processed. Hearth may forward your notice to the user who posted the content.

3. Counter-notification

If your content was removed and you believe the removal was mistaken or misidentified, you may send a counter-notification to our DMCA agent with:

  • Your physical or electronic signature.
  • Identification of the material removed and where it appeared before removal.
  • A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification.
  • Your name, address, telephone number, and consent to jurisdiction of the federal district court for your address (or San Diego County, California if outside the U.S.).

If we receive a valid counter-notification, we may restore the content after at least ten (10) business days unless the original complainant files a court action.

4. Repeat infringers

Hearth may terminate accounts of users who are repeat copyright infringers in appropriate circumstances.
